Federal Judge Evaluates HP’s Dynamic Security for Potential Computer Crimes Breach. A US federal judge will determine whether HP’s printer ink firmware updates, known as Dynamic Security, violate computer crimes laws. California’s Javitch Law Office seeks summary judgment on whether the collection of data through these updates breaches the Computer Fraud and Abuse Act (CFAA), California Computer Crimes statutes 502(c)(1)-(5), laws prohibiting false claims of needed replacements, and laws against false advertising.
According to the case, HP allegedly infringed upon § 502(c)(2) and (c)(3) by accessing and utilizing data about cartridges without authorization, as stated in document Dkt. 52, page [citation].

Representing the plaintiffs in this matter are MOBILE EMERGENCY HOUSING CORP., TRACK RAT ENTERPRISES, INC. doing business as PERFORMANCE AUTOMOTIVE & TIRE CENTER, and David Justin Lynch, both individually and on behalf of others similarly situated. They are taking legal action against HP INC., also known as HP COMPUTING AND PRINTING INC., a Delaware Corporation, with the law office of Mark L. Javitch serving as their legal representative.
