    HP Takes On APM, MicroJet, Mipo, Mipo America, and PTC (Again)

    Over the past year, we have written much about U.S. International Trade Commission (ITC) investigation 337-TA-723, “Certain Inkjet Cartridges with Printheads and Components Thereof,” brought by HP against Asia Pacific Microsystems (APM) of Taiwan, MicroJet Technology of Taiwan, PTC Holdings of Taiwan, Mextec (doing business as Mipo America) of Miami, FL, Mipo Technology of Hong Kong, Mipo Science and Technology of China, and Sino Time Technologies (doing business as All Colors) of Miami, FL. In October, the ITC issued its final determination in the investigation (see “ITC Issues Final Determination in HP Integrated Inkjet Cartridge Investigation”). The ITC found APM, MicroJet Technology, and PTC Holdings liable for infringement and issued a general exclusion order that bars the importation into the United States of all products violating certain patents used in some of HP’s most popular integrated inkjet cartridges, including the HP 21, HP 22, HP 27, HP 28, HP 54, HP 56, HP 57, HP 58, and HP 59. We have, however, written nothing about HP’s parallel complaint against the same defendants before the U.S. District Court for the Northern District of California, largely because the case was stayed pending the resolution of the ITC investigation. Now, it appears that the district court case may once again moving forward.
