In a landmark decision, the Unified Patent Court (UPC) has granted Fujifilm Corporation a cross-border injunction against Kodak, marking the court’s first injunction covering the UK. The ruling stems from a patent dispute over lithographic printing plate technology—a core area of competition in the commercial printing industry.

The court found that Kodak infringed European Patent EP 3 511 174 B1, which covers processless thermal printing plates used in offset printing. As a result, Kodak has been barred from selling or importing the infringing products in the United Kingdom.

This decision is particularly significant because it confirms the UPC’s authority to enforce UK-designated parts of European patents, even post-Brexit. While another related patent (EP 3 476 616 B1) was invalidated, the injunction over EP ‘174 marks a major legal win for Fujifilm and sets a precedent for patent enforcement across Europe—including in non-EU jurisdictions.

The case highlights the growing influence of the UPC and the importance of intellectual property rights in the evolving print technology sector.
