    A federal court in Pennsylvania has denied Staples, Inc.’s request to dismiss a lawsuit filed by a 60-year-old female account manager alleging she was fired due to her age and sex. Staples had argued that the termination was based on poor work performance, but the court found enough evidence suggesting this explanation might be a cover-up for discrimination.

    The case, filed under Title VII of the Civil Rights Act and the Age Discrimination in Employment Act (ADEA), will now proceed to trial where a jury will determine whether Staples unlawfully discharged the employee because of her protected status.

    This decision highlights the court’s willingness to closely examine employer reasons for termination, especially when allegations of bias against older female workers are involved.
