U.S. ITC Moves Forward in Epson Ink Cartridge Patent Case as Multiple Respondents Found in Default The U.S. International Trade Commission (ITC) has announced that it will not review an administrative law judge’s determination finding several respondents in default in Investigation No. 337-TA-1451, involving alleged patent infringement of Epson ink cartridges. The decision allows the default ruling to stand as the case proceeds toward potential trade remedies.
Most respondents are manufacturers or e-commerce sellers based in Guangdong, Jiangxi, or Hong Kong.

Many respondents operate online under multiple trade names and allegedly import or sell aftermarket ink cartridges that infringe Epson’s patents. Some failed to participate in the investigation, leading the administrative law judge to issue an Initial Determination finding them in default. The ITC’s decision not to review that order means the finding becomes final.
The Office of Unfair Import Investigations (OUII), which serves as an independent party representing the public interest, is also participating in the case. With the default ruling now in effect, the Commission may move toward issuing exclusion orders or cease-and-desist orders against the defaulting parties if it ultimately finds a violation of Section 337.
