    An OEM perspective on compatible clone cartridges

    Original printer equipment manufacturers, known as OEMs, including Canon Inc. and Lexmark, have filed various complaints against remanufacturers in China, the USA and elsewhere over printer cartridges deemed to be unlawfully infringing their patents.

    Back in 2010, Canon Inc. (Japan), Canon U.S.A., Inc. and Canon Virginia, Inc. successfully filed a 337 complaint with the U.S. International Trade Commission (ITC), alleging Ninestar and nine affiliated businesses in China and Hong Kong, as well as 10 U.S. companies had unlawfully imported infringing toner cartridges and related products into the United States.

    Lexmark filed a patent infringement suit in the United States District Court for the Southern District of Ohio against 24 companies including Ninestar, Print-Rite and ACM that manufacture, import, and sell replacement cartridges for various Lexmark laser printers and multifunction devices.

    On January 23, 2012, Japan-based Canon Inc. and its two American subsidiaries Canon U.S.A., Inc. and Canon Virginia, Inc., filed complaints to the ITC requesting an investigation under section 337 of the Tariff Act of 1930, regarding certain toner cartridges and components. Companies listed include Clover Technologies, Orink Infotech and Nukote Inc.

    Why are the OEMs aggressively chasing after remanufacturers? What do they think of the development of the supply of aftermarket cartridges? How can OEMs and remanufacturers coexist?

    On September 23, 2012, Andrew Gardner, Worldwide Brand Protection Manager, Lexmark International, will speak at Conference@2012 on An OEM perspective on compatible clone cartridges. Andrew will clearly identify Lexmark’s view and discuss with remanufacturers how a coexistence between OEMs and remanufacturers might work.

    Andrew Gardner is the worldwide brand protection manager for Lexmark International. He manages the Lexmark corporate brand protection program to combat the counterfeiting, grey marketing and intellectual property issues that affect the company’s printer supplies. Gardner joined Lexmark in May 1997 and held various positions in the U.S. and worldwide sales, marketing and finance groups before assuming his current role in June 2004. He is the treasurer of the Imaging Supplies Coalition (ISC) and on the board of the Imaging Consumables Coalition of EMEA (ICCE).

     “This is the first time an OEM has explained their views to remanufacturers in China. This will help remanufacturers to understand the position of OEMs. Further, OEMs will gain an insight of the aftermarket industry through this conference, laying a foundation to cooperate in the future. I believe this is a good opportunity for OEMs and remanufacturers to communicate,” says Tony Lee, managing director of Recycling Times Media Corporation.

    Conference@2012 will be held on September 23, 2012 in Zhuhai Holiday Inn. It is estimated that 200 industry leaders from 15 countries and regions will attend the conference.

    Another OEM—Xerox Corporation—will also be present. Edul N. Dalal, Research Fellow at Xerox, will deliver the keynote presentation at Conference@2012 called The Growth of Color Printing Based on Digital Imaging Technology.
