Canon USA Accuses North Carolina Business Of $2,150,000.00 Fraud
By Greg Barnes Staff writerCanon USA Inc. alleges in a lawsuit that a Fayetteville business equipment dealership owes the company more than $2 million.
In it's lawsuit, dated Sept. 29, Canon says Cavin's Business Solutions committed fraud and breach of contract and violated the state's unfair and deceptive trade practices act.
Cavin's lawyer, Jonathan Charleston, disputed Canon's allegations, saying Canon has filed similar lawsuits against other businesses throughout the country.
"Cavin's plans to vigorously defend this lawsuit, just as the numerous other dealers across the country intend to," Charleston said.
Cavin's, on Hay Street, has been in business since 1959, according to its website.
In the lawsuit, Canon alleges that Cavin's participated in a promotional program known as the Canon Strategic Marketing Plan, which offers Canon's authorized dealers incentives and rewards for attracting larger customers that acquire Canon business equipment for a year or more.
The lawsuit says Cavin's "submitted false and fraudulent information to Canon" while participating in the program.
Among other things, Canon alleges that a substantial percentage of Cavin's purchases of Canon-brand business equipment was attributed to acquisitions by customers in the rewards program.
The lawsuit says finance statements were filed reflecting serial numbers of business equipment that Cavin's claimed for program customers were actually placed with other customers.
In May, the lawsuit says, Cavin's admitted that it had wrongfully obtained reward credits from Canon's program "and that it owed Canon USA $2,154,379.00 for the remainder of the purchase price for business equipment."
Charleston said Cavin's "categorically denies" any wrongdoing or admission that it owes Canon money
The lawsuit says Cavin's has failed to pay Canon, which is seeking treble damages.
