EPSON AND GREEN PROJECT END 2 YEAR LEGAL BATTLE

Seiko Epson and Green Project have ended their two-year legal battle with a confidential settlement agreement.
In 2009 Epson filed a patent infringement complaint against 7 companies, including Green Project, the Los Angeles, California-based aftermarket company. The infringement involved three different inkjet cartridge patents, No. 6502917, 7008053 and 7011397. Green Project’s president, Joseph Wu was also named as an independent respondent in the case as well. Green Project were quick to deny the allegations and made counterclaims accusing Seiko Epson of trade secret misappropriation, trespassing and unfair competition.

The fierce legal battle was finally settled with both parties withdrawing their claims and counterclaims respectively. Epson and Green Project both agreed on a consent judgment and permanent injunction, which was signed by Judge Anna J. Brown.

Due to the confidential nature of the settlement, there is no further information available. However according to Actionable Intelligence, “Under the consent order, Green Project and its officers and directors, as well as Hyson International, Inc., and Nuimage Tech, Inc., are permanently enjoined from the sale of the accused products or ‘other products not colorably different therefrom,’ The defendants also have agreed to refrain from ‘other acts that directly or indirectly infringe any claim of the Epson Patents.’”
