HP Resolves Ink Cartridge Patent Suit With Brazil’s Maxprint
PALO ALTO, CA, Sep 2012 — HP today announced that it has amicably resolved patent litigation with Brazil-based Rio Branco Ltda., distributor of the Brazilian brand Maxprint, relating to HP’s integrated printhead inkjet cartridges.(1)
As part of the settlement, Maxprint acknowledges that HP’s patents are valid and enforceable. Maxprint has agreed to stop selling the cartridges in question in Brazil and in other countries where Maxprint-brand cartridges are sold. HP and Maxprint have agreed to allow Maxprint to sell any remaining inventory until Dec. 1, 2012, after which all infringing product sales by Maxprint must cease. Maxprint also will reimburse part of the litigation costs to HP.
The settlement is based on litigation filed by HP in the Brazilian State Court of Sao Paulo on April 12, 2011, alleging the importation and sale of HP-compatible inkjet print cartridges in Brazil that infringe on HP patents.
Additionally, as part of a wider patent enforcement program in Brazil, HP has reached agreements with several companies regarding the sale of the same print cartridges in Brazil. Those companies are:
— Canal Verde, of Sao Paulo
— Ecologic Technologica of Sao Paulo
— Edeltec, of Maringa
— Extralife Industria E Comercio Ltda., of Santana de Parnaiba
— Mipo Technology Ltd., of Hong Kong
— SOS Cartuchos, of Sao Paulo
— Suprijet, of Sao Paulo
Upon being contacted by HP, each of these companies confirmed that the HP patents are valid and enforceable, that the products are covered by these patents and that each company would immediately take steps to cease from offering or selling products in Brazil affected by those patents."We are committed to pursuing legal enforcement to protect our technological innovations — not only the company’s intellectual property, but also the value we deliver to our customers," said Matthew Barkley, program manager, Intellectual Property and Brand Protection Programs, HP.
