Hp Withdraws And Terminate U.S. 337-TA-1011 Investigation Of Memjet.
ALJ Bullock Terminates Investigation In Certain Inkjet Printers, Printheads, And Ink Cartridges.On August 1, 2016, Chief ALJ Charles E. Bullock issued Order Nos. 5 and 6 in Certain Inkjet Printers, Printheads, And Ink Cartridges, Components Thereof, and Products Containing Same (Inv. No. 337-TA-1011).
By way of background, this investigation is based on a May 27, 2016 complaint filed by HP Inc. of (“HP”) Palo Alto, California alleging violation of Section 337 by way of unlawful importation into the U.S., selling for importation, and/or selling within the U.S. after importation certain inkjet printers, printheads, ink cartridges, components thereof, and products containing same that infringe one or more claims of U.S. Patent Nos. 6,270,201; 6,491,377; 6,260,952; 7,004,564; 7,090,343; and 7,744,202. See our June 3, 2016 and July 7, 2016 posts for more details on the complaint.
According to Order No. 5, ALJ Bullock granted a joint motion filed by HP and Respondents Memjet, Ltd., Memjet US Services, Inc., Memjet Home and Office, Inc., Memjet North Ryde Pty Ltd., Memjet Technology Ltd., and Memjet Holdings Ltd. to terminate the investigation based on a settlement agreement.
According to Order No. 6, ALJ Bullock granted HP’s motion to terminate the investigation in its entirety based on a withdrawal of HP’s complaint as to the remaining Respondents.
