Judge Vindicates 123inkt.nl Again, Oem Samsung Goes Down!

JUDGE VINDICATES 123inkt.nl AGAIN in a patent dispute with Samsung. In the appeal, that was filed by Samsung, all claims have been rejected. 123inkt.nl may continue selling its own brand toners for Samsung printers.

 

Nederhorst den Berg, April 28 2015 – Last Tuesday, The Hague Court of Appeal decided in favour of 123inkt.nl in the patent dispute between Samsung and 123inkt.nl. Samsung demanded that 123inkt.nl stop selling some of its own brand toner cartridges for Samsung printers. They stated that the positioning of a certain chip on these toners would violate a patent owned by Samsung.

Samsung appealed when 123inkt.nl was vindicated in a judgment on 30th of October 2014. The Judge found the patent of Samsung not inventive enough. On appeal, all claims by Samsung were rejected by the court again. Chances are that the patent Samsung owns (EP 914) will be annulled under non-inventiveness in the ongoing substantive proceedings.

123inkt.nl-director Gerben Kreuning is pleased with the outcome of the lawsuit: “This statement is really fantastic! Not only may we continue to sell our cartridges, but the court found on two occasions that the patent Samsung owns is nonsense! Samsung thinks they can achieve a monopoly position by capturing a very obvious technology. We prove again that we do not just accept being dictated to by a supposedly powerful company from South Korea.”
