    VIRTUAL IMAGING PRODUCT INC SETTLES WITH LEXMARK
    Virtual Imaging Products, Inc. (“VIP”) is pleased to announce the amicable resolution of its litigation with Lexmark International, Inc.   Last year, Lexmark brought patent litigation at the U.S. International Trade Commission and in U.S. District Court in Ohio against a number of distributors and manufacturers of replacement toner cartridges, including VIP.  VIP and Lexmark have now reached a mutually satisfactory resolution of their differences.

    Among the terms of the settlements, Lexmark has released VIP from the two lawsuits and VIP has agreed to the entry of a final judgment and permanent injunction in the District Court litigation. In addition, VIP will not oppose Lexmark’s efforts to secure an order from the ITC banning future importation of infringing cartridges. The remaining terms of the settlements are confidential.
