    Steven Loy, an attorney with Stoll Keenon Ogden PLLC, argued a case before the U.S. Supreme Court this week on behalf of Lexmark International Inc.

    At issue is who has standing to sue for false advertising under the Lanham Act, a federal trademark statute.

    The case, Static Control Components Inc. v. Lexmark, involves a printer cartridge return program implemented by Lexmark in the late 1990s for laser printers sold primarily to medium and large businesses.

    Static Control, a Sanford, N.C.-based parts supplier to the remanufacturing industry, is fighting the program, claiming that Lexington-based Lexmark (NYSE: LXK) made false statements about it.

    According to a news release from Stoll Keenon Ogden, Loy argued Dec. 3 that Congress intended for the Lanham Act to allow only a narrow class of plaintiffs to file suit, a position that has been adopted by the Supreme Court in antitrust decisions.

    The Supreme Court is expected to rule on the case in late spring or early summer 2014.

    Loy has practiced law with Stoll Keenon since 1994 and focuses on intellectual property, antitrust and banking litigation.
