Over “Flagrant Misrepresentation of Ink Cartridge Yield.”
Epic Office Solutions, a Texas-based printer and multifunction printer (MFP) dealer, has recently filed a lawsuit against Epson America, Inc., one of the leading manufacturers of inkjet printers. The lawsuit seeks damages of $20 million and accuses Epson of fraud and negligence for “flagrantly misrepresenting the ink cartridge yields of its printers … resulting in extraordinary financial losses to Epic”.

According to the complaint, Epic Office Solutions entered a contract with Epson in 2023 to become an authorized dealer of Epson’s business inkjet devices, such as the WorkForce Pro and the EcoTank series. Epson allegedly promised that its printers would deliver high-quality prints at low costs, with ink cartridge yields ranging from 2,000 to 40,000 pages per cartridge.

However, Epic Office Solutions claims that Epson’s representations were false and misleading, and that the actual ink cartridge yields were much lower than advertised. For example, the complaint alleges that the Epson WorkForce Pro WF-C5790 printer, which was supposed to yield 10,000 pages per black cartridge and 5,000 pages per color cartridge, only yielded 1,500 pages per black cartridge and 750 pages per color cartridge.

As a result, Epic Office Solutions says that it suffered significant losses due to the increased costs of ink cartridges, the decreased customer satisfaction, and the damaged reputation of its business. The complaint also states that Epson was aware of the discrepancy between the advertised and actual ink yields but failed to disclose it to Epic Office Solutions or to remedy the situation.

Interestingly, this legal battle took a twist. Initially, Epic Office Solutions filed the lawsuit in the U.S. District Court for the Southern District of New York on December 26, 2023. However, they voluntarily dismissed it on February 19, 2024, and subsequently refiled the complaint in the U.S. District Court for the Central District of California on February 21, 2024.

This move appears to be in response to Epson’s intent to challenge the original complaint on grounds of personal jurisdiction and improper venue. Legal disputes in the tech industry can be quite intricate, and this case involving Epic Office Solutions and Epson is no exception.
