tonerKeymasterLawsuits Surge as Xerox, Lexmark, Canon, and Amazon AGAIN Take Action.
The battle against counterfeit toner and ink products rages on, with an alarming number of lawsuits emerging in recent months. Tonernews.com has documented countless legal actions over the years, and the trend shows no signs of slowing down. The influx of counterfeit products, primarily from Asia, combined with the ease of access provided by e-commerce platforms like Amazon, has fueled a rise in the distribution of Chinese clone toner and other counterfeit goods.Reputable toner remanufacturers find themselves struggling against this tidal wave of fakes and clones. They are often outmatched due to overproduction and a lack of support from e-commerce giants that turn a blind eye to their challenges. Recently, two significant lawsuits have come to light, involving industry heavyweights Xerox and Lexmark, as well as Canon and Amazon, targeting 18 resellers of counterfeit toner cartridges. While these legal efforts are crucial, they may barely scratch the surface of the larger issue, especially as long as U.S. customs continues to permit the entry of these goods.
Canon and Amazon Team Up Against Counterfeiters
On October 2, 2024, Canon Inc. and Canon U.S.A., Inc., in collaboration with Amazon.com, Inc. and Amazon Services LLC, filed a joint lawsuit in the U.S. District Court for the Western District of Washington. The lawsuit targets 18 selling accounts accused of infringing upon Canon’s trademark rights by selling counterfeit toner cartridges through the Amazon marketplace.Canon is committed to safeguarding its customers from counterfeit products that unlawfully exploit the Canon brand, jeopardizing both product quality and safety. The company’s proactive stance aims to uphold the value and reputation built over decades in delivering high-quality products. As e-commerce continues to expand, the damages caused by counterfeit goods are escalating. This joint legal action is part of Canon and Amazon’s strategy to combat counterfeiters and protect their customers.
Amazon, Xerox, and Lexmark Unite Against Counterfeit Toners
In another significant development, Amazon, Xerox, and Lexmark have filed a joint lawsuit targeting sellers of counterfeit toner cartridges on the Amazon platform. The lawsuit alleges that these sellers have inflicted damage on the brands, eroded consumer trust, and disrupted revenue streams.Filed in the U.S. District Court for the Western District of Washington, the lawsuit claims that various defendants, including companies like Direct Global Supplies and Zeal Est LLC, sold counterfeit cartridges misrepresented as Xerox and Lexmark products. These products were falsely marketed as high-capacity, premium items, despite being low-capacity replicas.
The plaintiffs assert that these counterfeit cartridges not only breach intellectual property laws but also undermine the integrity of Amazon’s marketplace. Amazon has reportedly invested over $1.2 billion annually in the fight against counterfeit goods and has taken steps to block the implicated seller accounts after confirming the infringement.
Xerox and Lexmark contend that the counterfeiters employed unauthorized trademarks, fake holographic labels, and deceptive security features, misleading customers into purchasing substandard products. The companies argue that these sales have harmed their brand reputations and caused significant financial losses by diverting customers from authentic offerings.
Key individuals behind the alleged operation, Varkha N. Primalani and Prakash Lakhani, are implicated through their companies, Direct Global Supplies and Zeal Est LLC. Amazon’s Brand Registry and Project Zero programs played a crucial role in identifying the counterfeit activity, leading to test purchases that confirmed the fraudulent nature of the products.
The plaintiffs seek damages, an injunction against further sales of counterfeit goods, and reimbursement for legal expenses. This case highlights the ongoing challenges faced by e-commerce platforms and brand owners in their efforts to combat counterfeit sales in the increasingly global online marketplace.
In 2023, Amazon, Xerox, and Lexmark filed another significant lawsuit (Case No. 2:23-cv-00577) in the U.S. District Court for the Western District of Washington, targeting individuals and companies selling counterfeit toner cartridges on Amazon. The involved defendants, including Riverday Ltd. and Smyrna Company US LLC, were found marketing products bearing fake trademarks of Xerox and Lexmark. Amazon promptly shut down the seller accounts after verification and issued full refunds to affected customers.
As the fight against Chinese Clones and counterfeit toner products continues, the stakes remain high for legitimate toner remanufacturers and consumers alike. it’s time for the US government to ban all toners that are made and coming from China, it’s also time to US resellers and wholesalers accountable, Tonernews.com has recently ask for help from the FBI to shut down prolific Ninestar and others such as Hubey Dinglong, Mito, Printrite, Aster G. and other to stop the importation, let’s hope they come to the rescue soon.
