    Decision in Meta’s Favor, Rejecting Xerox’ Latest Appeal.

    In a recent decision, the Federal Circuit declined to review a ruling that upheld the Patent Trial and Appeal Board’s (PTAB) invalidation of claims in a Xerox patent, marking a significant victory for Meta Platforms Inc. The case centers on Xerox’s accusation that Meta infringed on U.S. Patent No. 9,137,190, a patent related to systems for identifying and flagging misinformation using artificial intelligence.

    The dispute began in 2020 when Xerox filed a patent infringement lawsuit against Meta, claiming that the social media giant’s AI-driven systems violated its patent. However, Meta, along with other tech companies such as X Corp. (formerly Twitter) and Snap Inc., challenged the patent’s validity at the PTAB. The PTAB sided with the challengers, ruling that the claims in the ‘190 patent were invalid due to their similarity to prior known technologies.

    Xerox then appealed the PTAB’s decision to the Federal Circuit, which held oral arguments in December 2024. In March 2025, the Federal Circuit upheld the PTAB’s decision, effectively affirming Meta’s stance. Xerox requested an en banc rehearing, which was ultimately denied, solidifying the ruling in Meta’s favor.

    This case underscores the ongoing difficulties faced by patent holders, especially when their intellectual property is contested by large technology companies. With the Federal Circuit’s refusal to intervene, the ruling sends a clear message about the rigorous scrutiny patents face in the modern tech landscape.
