HP Inc.’s long-running legal battle over genuine ink cartridges sold without their original outer packaging has suffered another setback after the Dutch Supreme Court rejected its cassation appeal in the dispute involving Digital Revolution and several businesses connected to 123inkt. The decision leaves the Court of Appeal in The Hague’s April 8, 2025 judgment standing and orders HP to pay €30,000 in costs for the main cassation proceedings, while Digital Revolution—whose own incidental appeal was also rejected—must pay €2,200. The fight raises a potentially explosive question for Europe’s multibillion-dollar printer supplies market: how much control should an OEM like HP retain over genuine cartridges after they have already entered the marketplace? With printer manufacturers aggressively protecting trademarks, packaging and distribution channels while independent dealers compete to resell genuine supplies, the ruling could attract serious attention from cartridge resellers across Europe.
