Fujifilm has asked the U.S. Court of International Trade to reject the latest determination by the U.S. International Trade Commission (ITC) in the ongoing antidumping and countervailing duty investigation involving aluminum lithographic printing plates imported from Japan and China, arguing that the agency failed to comply with the court’s previous remand order. According to Fujifilm, the ITC simply repeated its earlier injury analysis without adequately addressing concerns about the condition of the U.S. domestic industry and competitive market conditions. The latest filing comes as Fujifilm remains engaged in a separate high-profile global legal battle with Kodak over lithographic printing plate patents. Earlier this month, the Unified Patent Court (UPC) Court of Appeal overturned injunctions that had previously restricted Kodak’s sales of certain printing plates in Germany and the United Kingdom, ruling that Kodak did not infringe one of Fujifilm’s key patents while also clarifying the UPC’s “long-arm” jurisdiction over UK-designated European patents.
