    The Xerox solar project in Webster, New York, has been delayed again after the town’s Zoning Board of Appeals (ZBA) postponed a decision on a legal challenge to the project’s approval process. The proposed “Webster Solar Garden,” a partnership between Xerox and Montante Solar, would be built on roughly 19 acres of the former Xerox campus. Opponents argue the Town Board approved the project using the wrong type of permit—an Industrial Use Permit instead of a Special Use Permit—which could have required a different review process. The Town Board previously approved the project in a narrow 3-2 vote, despite vocal opposition from some residents concerned about safety, environmental impacts, and the use of land near a capped industrial landfill. The ZBA has not yet ruled on whether it even has the authority to overturn or review the Town Board’s decision, making the procedural dispute just as important as the solar project itself. The case has now become a high-profile battle over zoning, local government authority, and the future use of the former Xerox property.
