BROTHER MOVES TO BLOCK I.P. INFRINGEMENT FOR LC-61 CARTRIDGES IN EUROPE

Brother has recently applied for a utility model in Germany in relation to its LC61 cartridge.
The utility patent model allows a company to register a model without an examination of its validity. This then allows the owner to have the same rights as if the product was granted a full patent. The implication of this move from Brother is that the OEM has secured protection for the product before it has received approval for the patent. For remanufacturers in the German market looking to remanufacture this cartridge, this is a worrying move, and other OEMs could soon become wise to this change and act accordingly to protect their products.Brother has also made three other patent applications in reference to the LC61 cartridge.
