Canon Inc Looses Key Ruling To Remanufacturer In South Korea
Trade commission acquits laser printer parts firms of patent violations
SEOUL South Korea, Sept. 2011 — South Korea’s state trade commission on Thursday acquitted local laser printer parts companies of violating patent rights claimed by Canon Inc.
The decision was reached after a review of claims made by all companies involved, as well as onsite inspections and technical evaluations by independent experts, the Korea Trade Commission (KTC) said.
The Japanese company filed a formal complaint in May claiming that five South Korean manufacturers infringed on its patent right when making parts of optical photo-conductive (OPC) drums used in laser printers. The drums that generate light and heat permit the print toner inks be attached to the paper.
Canon had asked the regulatory agency under the Ministry of Knowledge Economy to stop the companies from producing and exporting the OPC drums.
The KTC, however, said that after detailed examination of all issues raised, it ruled that Canon’s claims of patent rights were excessive and could be abused to prevent other companies from legitimately making the crucial component needed in laser printers.It added that the manufacturing and exporting of the drums could not be considered unfair.
