    Chinese Staples Are Now Sold At Unfair Prices In the U.S.

    Law360, New York (November 3, 2017, 10:51 PM EDT) — The U.S. Department of Commerce has determined that imports of carton-closing staples from China have been sold at unfairly low prices in the U.S., increasing the chances that anti-dumping duties could be imposed on the product, according to a notice published in the Federal Register on Friday. 
    Commerce’s International Trade Administration issued a notice in April announcing that it was initiating an investigation into imports of the product, following a petition by North American Steel & Wire Inc. and its affiliate ISM Enterprises with Commerce in late March.

    “The Department of Commerce preliminarily determines that carton closing staples from the People’s Republic of China are being, or are likely to be, sold in the United States at less than fair value,” the agency said in the Federal Register.

    The U.S. International Trade Commission issued a preliminarily determination in mid-May that the domestic industry is being harmed by the imports.

    Specifically, North American Steel & Wire and ISM Enterprises filed petitions with the government at the end of March asserting that Chinese companies were selling their carton-closing staples at unfairly low prices, and demanded anti-dumping duties ranging between 13.76 percent and 263.43 percent to mitigate the damage done to its bottom line.

    Commerce will issue its final anti-dumping duty calculations within 135 days, but no tariffs will be put into place unless the ITC makes a final determination about the harm that the imported staples are causing to domestic production.

    In its petitions, the two U.S. companies identified more than 30 Chinese staple producers that they say are dumping their merchandise onto the U.S. market. Commerce reported that imports of those staples were valued at $72 million in 2016.

    North American Steel & Wire and ISM Enterprises are among the litany of U.S. companies filing trade cases since the Trump administration assumed power on a robust enforcement platform that has energized many trade lawyers.

    An attorney for North American Steel & Wire and a representative for one of the respondents, Shanghai Yueda Nails Co. Ltd., did not respond to a request for comment after business hours late Friday.

    North American Steel & Wire and ISM Enterprises are represented by Elizabeth J. Drake, Terence P. Stewart, William A. Fennell, Philip A. Butler, Jennifer M. Smith, Nicholas J. Birch and Sahar J. Hafeez of the Law Offices of Stewart and Stewart.

    Counsel information for the respondents was not immediately available.

    The dumping case is Carton-Closing Staples From the People’s Republic of China, investigation number A-570-055, in the U.S. International Trade Administration.
    The injury case is Carton-Closing Staples From the People’s Republic of China, investigation number 731-TA-1359, before the U.S. International Trade Commission.
