Two major manufacturers go for the jugular
The pressure against manufacturers of compatible inkjet cartridges is being stepped up by major printer manufacturers.
In the US, HP has accused a US cartridge reseller of refilling used printer cartridges with ink that relies on a formula for an HP-patented ink brand. HP wrote to Cartridge World and asked it to stop using inks with the same chemical composition that is found in its patented brand of Vivera inks.
This is part of a broader move against manufacturers of compatible ink cartridges.
In March, HP uncovered alleged patent infringement in certain InkCycle cartridges sold under the Staples brand.
This case was resolved after InkCycle changed its ink formulations. and follows on from recent court action taken by Epson. Epson filed patent infringement proceedings in the English High Court against CybaHouse to stop the importation from China, and supply within the UK, of certain Epson compatible printer cartridges.
Epson has now agreed to settle the case out of Court, based on undertakings from CybaHouse its sister company Nutronic Limited and their directors that they will cease trading in the Epson compatible cartridges. The settlement terms also include the payment by CybaHouse Limited of Epson’s legal costs plus an undisclosed sum in respect of damages. The full terms of the settlement are confidential.
This case follows another brought by Epson which was also recently settled with Environmental Business Products. EBPL also agreed to stop importing and supplying Epson compatible ink cartridges.
