    Epson Questions If Town Sky Assets Were Illegally Transferred

    Town Sky, a former distributor of Ninestar products once based in San Francisco, CA, filed for Chapter 7 bankruptcy protection a year and a half ago (see “Ninestar Distributor Town Sky Goes Bankrupt”). Interestingly, the International Trade Commission (ITC), Epson America, Epson Portland, and Seiko Epson have since been appointed some of the firm’s creditors. Undoubtedly, this is the result of the $11.1 million fine that the ITC ordered Ninestar and its affiliates to pay for violating a general exclusion order barring the importation of most Epson ink tanks designs, a fine that Ninestar is currently appealing, and Epson’s pending patent-infringement complaint against Ninestar and others before a district court in Portland, OR, in which the OEM has the potential to collect damages.
