Update on Summary Judgment Hearing in Epson Patent-Infringement Complaint against Ninestar Epson’s patent-infringement complaint against Ninestar in district court is scheduled for trial next spring. Leading up the trial, Judge Anna J. Brown held hearings this fall to issue various summary judgments. One set of hearings was held September 15 and 16 (see “District Court Judge Finds Ninestar Infringed Epson’s Patents”), and another day of hearings was held October 3 (see “Patent-Exhaustion Defense Shot Down in Epson Suit against Ninestar in District Court”). When we wrote about some of the results of the October 3 hearing, Judge Brown had yet to issue an order summarizing her rulings. Now, such an order had been made public, so we wanted to revisit this case to report on some additional findings not covered in our previous article on the October 3 hearings.
