A copy services firm accused of overcharging a Gloucester County school district by $50,000 claims the district was “paying exactly what it agreed to pay.”

Konica Minolta Business Solutions filed a response and a counterclaim Monday to the Monroe Township Board of Education’s October lawsuit.

The school district alleges Mario DiNatale — Voorhees Township’s deputy mayor and a salesman for the copy company — made a false sales pitch last year, promising the district $11,000 in savings if it dropped Xerox and hired Konica Minolta.

DiNatale is co-founder and treasurer of Alicia Rose Victorious Foundation, a charity named for his daughter who died in 2002 after battling a rare form of cancer.

The school board’s lawsuit alleges that in spite of DiNatale’s pitch, the district discovered it paid an additional $10,630 a month to Konica “for the same or less copy services” provided by Xerox.

Konica Minolta denied the district’s claim and says DiNatale relied on “false and untrue” usage figures provided by the district.

The Bergen County-based firm contends its contract price was based “on the accuracy of the information” supplied by the district. Konica was “led to believe that the usage level … was higher than it was,” according to its court filings.

The company is countersuing, claiming the school district breached the contract when it failed to pay its full obligation.
