Lexmark v. Static Control: Multifaceted Appellate Hearing All About Prebate
On March 6, Static Control’s and Lexmark’s lawyers were back in front of the same appellate court that overturned a Lexington judge’s ruling that heavily favored Lexmark. At the end of the day, Tricia Judge reported, only two issues were actually argued, and they were both issues raised by SCC in its appeal, leaving Lexmark’s claims unconsidered. Those issues were Static’s appeal of the lower court’s decision that its antitrust and unfair competition claims could not be sustained because Static Control does not directly compete with Lexmark, and the other issue was money. With a little luck, coupled with good legal preparation and representation, SCC might be in store for another tremendous victory. After investing $30 million in this 10-year litigation, it would be a well-deserved one.

Canon Settles With Imaging Resources and Do It Wiser, Other Companies Deny Allegations
Canon announced the resolution of patent infringement disputes with Imaging Resources and Do It Wiser DBA Image Toner. The resolution reached in the U.S. District Court for the Southern District of New York concerns Canon’s USITC complaint that alleged that these and many other companies violated Section 336 of the Tariff Act of 1930, specifically the “projection at the end of the drum that enables … a detachable coupling.” As a result of the resolution, Imaging Resources and Image Toner have stipulated to a consent judgment and permanent injunction, which will prohibit the company from making, using, selling and offering for sale in the U.S., and from importing into the U.S., these toner cartridges and their photosensitive drums. Clover companies, Dexxon Digital Storage, Discount Office Items, Deal Express LLC, GreenLine Paper Company, Myriad Greeyn, Office World, OfficeWorld.com, Acecom (DBA InkSell.com) and Green Project have all filed responses denying the allegations of infringing Canon’s patents.
