Last Updated: October 31, 2013We have no obligation to monitor your use of the Program. You agree, however, that we retain the right to monitor your use of the Program and to disclose any information (including but not limited to content) as necessary or appropriate to satisfy any law, regulation or governmental request, to operate the Services properly, to ensure your compliance with these TOS, and to protect us, our affiliates, other users and the general public.
We reserve the right, and you hereby authorize us, to cooperate with law enforcement authorities, including but not limited to complying with warrants, court orders and subpoenas. We also reserve the right, and you hereby authorize us, to comply with any civil court orders and subpoenas. In addition, if we decide to investigate or resolve possible misuse by you involving the Services, the App or the Site, you hereby consent to our disclosure to law enforcement or other government officials any information about you in our possession in connection with your use of the Services, the App and the Site.
TO THE EXTENT PERMITTED BY LOCAL LAW, YOU AGREE TO WAIVE ANY CLAIMS YOU MAY HAVE AGAINST US AND AGAINST OUR SUBSIDIARIES, AFFILATES, OUR AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, LICENSORS, PARTNERS AND SUPPLIERS (COLLECTIVELY, “HP AFFILIATES”) RELATING TO ANY ACTION TAKEN BY US OR ANY HP AFFILIATES AS PART OF OUR OR THEIR INVESTIGATION OF A SUSPECTED VIOLATION OF THESE TOS, ANY ACTION TAKEN BY US OR ANY HP AFFILIATES AS A RESULT OF OUR OR THEIR CONCLUSION THAT A VIOLATION OF THESE TOS HAS OCCURRED, OR ANY ACTION TAKEN BY US OR ANY HP AFFILIATES IN CONNECTION WITH ANY CIRCUMSTANCES REFERENCED IN OR OTHERWISE RELATED TO THIS SECTION. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU AGREE THAT YOU MAY NOT RECOVER ANY DAMAGES WHATSOEVER FROM US OR ANY HP AFFILIATES AS A RESULT OF (i) REMOVAL OF YOUR CONTENT FROM THE SERVICES, APP, OR SITE (ii) SUSPENSION OR TERMINATION OF YOUR USE OF THE SERVICES, (iii) ANY OTHER ACTION TAKEN DURING THE INVESTIGATION OF A SUSPECTED VIOLATION, OR AS A RESULT OF OUR OR ANY HP AFFILIATE’S CONCLUSION THAT A VIOLATION OF THESE TOS HAS OCCURRED, OR (iv) PROVISION OF YOUR CONTENT OR OTHER INFORMATION TO THIRD PARTIES PURSUANT TO THIS SECTION. YOU HEREBY RELEASE US AND ALL HP AFFILIATES FROM ANY LIABILITY WHATSOEVER WITH RESPECT TO THE FOREGOING.
The HP SureSupply program (the “Program”), provided to you by Hewlett-Packard Company (“HP”). We use the terms “you” and “your” to refer to any person who at any point or for any amount of time uses the HP SureSupply services (the “Services”) or accesses the HP SureSupply mobile app (“App”) or the HP SureSupply website at http://www.suresupply.com or its successor website (the “Site”), and we use the terms “we”, “us” and “our” to refer to HP and our employees and agents.
Binding terms of service
These Terms of Service (“TOS”) constitute a binding legal contract between you and us and set forth the terms that govern your access to and use of the Program, Services, the App and the Site.
ATTENTION: PLEASE READ THESE TERMS CAREFULLY. BY DOWNLOADING OR USING THE APP OR BY USING THE SERVICES THROUGH THE SITE YOU AGREE TO BE LEGALLY BOUND BY THESE TOS. IF YOU DO NOT ACCEPT THESE TOS, DO NOT DOWNLOAD OR USE THE APP, DO NOT ACCESS THE SITE AND DO NOT USE THE SERVICES. Your use of the Program, the Services, the App and the Site are conditioned on and subject to your compliance with these TOS.
To use the Services, you must either access the Site or download the App from the applicable mobile platform app store (e.g., Apple App Store, Google Play App Store, etc.) and accept the TOS. You must be at least 18 years of age and you must have reached the age where you have the legal capacity and authority, within the applicable jurisdiction, to enter into a binding contract to use the Program. If you are using the Program on behalf of an entity, you must be, and hereby warrant that you are, duly authorized to enter into a binding contract on behalf of that entity.
