US ITC Terminates Investigation On 4 of Canon's Toner Patents Vs. Distributors And Remanufacturers
ALJ Shaw terminates investigation as to certain patents in Certain Toner Cartridges (337-TA-918)

On August 14, 2014, ALJ David P. Shaw issued Order No. 11 in Certain Toner Cartridges and Components Thereof (Inv. No. 337-TA-918).

By way of background, this investigation is based on a May 7, 2014 complaint filed by Canon Inc.; Canon U.S.A., Inc.; and Canon Virginia, Inc. (collectively, "Canon") alleging violation of Section 337 in the importation into the U.S. and sale of certain toner cartridges and components thereof, namely photosensitive drum units, that infringe one or more claims of U.S. Patent Nos. 8,280,278 (the '278 patent); 8,630,564 (the '564 patent); 8,682,215 (the '215 patent); 8,676,090 (the '090 patent); 8,369,744 (the '744 patent); 8,565,640 (the '640 patent); 8,676,085 (the '085 patent); 8,135,304 (the '304 patent); and 8,688,008 (the '008 patent). See our May 8, 2014 and June 11, 2014 posts for more details on the complaint and the notice of investigation, respectively. 

According to Order No. 11, ALJ Shaw granted Canon's request to partially terminate the investigation as to the '744, '640, '085, and '304 patents. Accordingly, only the '278, '564, '215, '090, and '008 patents remain in the investigation. ALJ Shaw held that no extraordinary circumstance exists that would warrant denying the motion to terminate. ALJ Shaw further noted that granting the motion conserves public and private resources by reducing the number of asserted claims from thirty-two to twenty-five and the number of asserted patents from nine to five.
