    Why Lexmark’s New Threats of Suing Universal Imaging Industries is AGAIN a Complete Waste of Time.

    It is not surprising that the patent office does not want to review patents that they have previously issued, which would make the patent office look bad.  The important point to note is that UII’s chips contain their own patent pending technology and they do not infringe any of Lexmark’s patents. As we have said from the very beginning, this lawsuit is simply a strategy by Lexmark’s owner, Apex China, to try to eliminate the Lexmark remanufacturing industry.  As the remanufacturing industry will never forget, prior to UII’s release of MS/MX chips, Apex China and Static Control drastically raised prices on Lexmark aftermarket MS/MX chips and then a few weeks later, completely stopped supplying these chips to the remanufacturers, leaving all of the remanufacturing companies completely unable to fulfill orders.  Weeks later, UII spoiled Apex China’s plans by releasing MS/MX chips to the industry, so now Apex China is using its daughter company, Lexmark, to try to gain complete control of the remanufacturing industry once again.

    Companies that Steve Miller has owned have been in many patent lawsuits with Lexmark and Static Control for nearly 20 years and have always prevailed, and once again will prevail against this frivolous attack on the remanufacturing industry.
