The designation of “Confidential Information” is removed from pages 220 through 228 of the CAR, which are now included in the PAR.
The specified portions of the CAR in the Confidential Appendix are to be unredacted and treated as Confidential Information per APO ¶ 1. The Confidential Appendix is attached to the sealed version of this opinion on the USCIT docket.
Plaintiffs’ counsel and anyone who has received USTR and State Productions from Plaintiffs’ counsel must promptly destroy all physical and electronic copies, except for rights preserved under 5 U.S.C. § 552.
Defendants are directed to submit revised versions of the PAR and CAR consistent with this opinion by 5 p.m. ET on July 12, 2024.
By 5 p.m. ET on July 19, 2024, the parties shall submit a joint status report
and proposed scheduling order governing subsequent proceedings in this case.
The filing should address Plaintiffs’ stayed Motion for Judgment on the Agency Record, ECF No. 109, and stayed Motion to Complete or Supplement the Administrative Record, ECF No. 108, as well as the timing of Plaintiffs’ delisting request. In the event of disagreement, Plaintiffs and Defendants may each file separate status reports and proposed scheduling orders.
