    HP Hit With NEW $25 Million Multi-State
    Antitrust Lawsuit Over Ink Cartridge (Software) Monopoly.
    A group of consumers sued HP Inc in a Chicago federal court, alleging that the company’s printers rejected ink cartridges from other sources and forced them to buy HP-branded cartridges at inflated prices.

    The lawsuit, filed on Friday as a proposed class action, accused HP of breaking federal and state laws by trying to monopolize the ink replacement market.

    The plaintiffs claimed that HP did not inform them that its software updates would make some printers unusable unless they had HP-branded ink. “Without working printers, the plaintiffs had no choice but to buy HP-branded ink that they otherwise would not have bought,” the lawsuit stated.

    HP did not comment on the lawsuit on Monday. Neither did the plaintiffs’ lawyers from Milberg Coleman Bryson Phillips Grossman.

    The lawsuit followed similar cases against HP over its ink cartridge practices. In 2019, HP settled a California case for $1.5 million, without admitting any wrongdoing, to resolve consumer complaints related to its ink cartridges.

    In August 2020, a California judge ruled that HP had to face allegations that it made some printers stop scanning and faxing when they ran low on ink, pressuring consumers to buy more cartridges.

    In December 2020, another California judge allowed plaintiffs to pursue a class-action lawsuit against HP for allegedly not disclosing its “Dynamic Security” policy of updates that prevented consumers from using some third-party cartridges.

    The judge limited the lawsuit to seeking an injunction against HP’s practices, not monetary damages. The lawsuit challenged HP’s disclosure of the policy, not the policy itself. In the Chicago case, the plaintiffs asked for an injunction to stop HP from disabling printers that did not use HP-branded ink, and more than $5 million in damages.
