    LAMA FRANCE Loses Patent Case
    as HP Secures First Win Over Counterfeit Toner Cartridges.

    HP has secured a victory in the initial phase of a significant patent dispute at the Unified Patent Court (UPC) in Paris. The case involves HP Inc. suing LAMA FRANCE, a French importer and distributor of non-genuine HP-compatible print cartridges. In response, LAMA FRANCE has denied the allegations and filed a counterclaim, arguing that the patents in question lack sufficient innovation.

    The Unified Patent Court in Paris has ruled in favor of HP, affirming the legitimacy of the lawsuit. LAMA FRANCE has been found responsible for manufacturing, importing, and selling unauthorized HP-compatible cartridges.

    HP is seeking damages of up to EUR 1 million (approximately CZK 25 million), as well as actions such as the recall and destruction of the infringing products. The court has awarded provisional damages of EUR 100,000 (about CZK 2.5 million), with the final amount to be determined in a future legal proceeding.

    The case centers on patents EP 2 089 230 and EP 1 737 669, which cover advanced liquid discharge technologies for inkjet printers. LAMA FRANCE has managed to challenge the novelty of key aspects of patent EP 2 089 230 by citing prior art from European patent EP’211.
